Joining as a Promotional Business Associate (PBA)

Or

as an Independent Business Associate (IBA)


The offer to become Promotional Business Associate (PBA) and an Independent Business Associate (IBA) is open for all individuals, sole proprietors, partnership firms, companies and other legally valid institutions, etc. The applicant should be of minimum 18 years of age and citizen of India. She / He should join as per her / his independent and un-influenced decision and not under any duress or compulsion.

Joining the Firm as it’s PBA / IBA offers an opportunity to promote various services / goods packages (present and or future) of Prominent Future Vision India (Here – in – after called as ‘PFVI’). However a PBA / an IBA will not function as an agent / employee of the Firm and will be referred to as a self employed person only.

Partners or directors or any other persons closely associated with her / him / them; is / are found to be indulging in anti–Firm activities, e.g., selling it’s products at excess–price than Plan Value; defaming the Firm; Hand – shaking with Firm’s competitors; doing any other business in Firm premises, etc.

Statutory taxes like Tax Deduction at Source (TDS) / GST etc; shall be deducted as per provisions under relevant Tax Acts, at the rates prevailing at the time of making payments / sale. TDS Certificate for the deductions made in a financial year shall be issued to the concerned PBA / IBA. Also specified Administrative charges may be deducted as per the existing and operating rules of the Firm from time to time.

Firm will not be held responsible if due to any act of God / Calamity / Change of Law or unforeseen circumstances, it is unable to perform it’s normal working (which may include stopping of working due to intervention of any Government Department or any other organization or any union or any person or group of persons). The PBA / IBA, hereby, accepts and agrees that no claim would be preferred / made by her / him, under such circumstances, against / upon the Firm.

The Firm will not be held liable for any non-functioning of its website due to any technical reason(s) / snags (including hacking or any other intervention of government for stopping the site or any virus). Still it is always suggested to confirm the status of website from the office of the Firm.

The Firm reserves the right to alter / change the business plan, prices and other charges and any or all of it’s terms and conditions. Notice of such change(s) shall be deemed to have been given and received by the PBA / IBA, immediately the same is notified by the Firm on it’s website. The PBA / IBA, hereby agrees to abide by such changes and undertakes complete responsibility to stay abreast of such developments (communicated in such fashion) through website. Any miscommunication or misspelling by any of the Associates may not be relied upon until direct confirmation from the Firm, in – writing, or through mail.

It is understood by all the Independent Associates that any benefits / payouts or other benefits are purely paid as performance bonus and are payable only in the condition of profit by the Firm and nobody has the right to sue the Firm on the ground of non – payment or late payment of any benefits. Firm’s decision in this regard will be final and binding on all affected.

Filling up of an application form (online or offline) and enrolment as it’s PBA / IBA by the Firm will not entitle such person to refer herself / himself as an employee or agent of the Firm.

PIN for online logging will be issued after receiving the amount through Cash or by Demand Draft or by Cheque (after it’s honoring). Cash may be deposited directly in Firm’s Bank Accounts or must be deposited at the Firm’s Office / Authorized Collection Center against a proper Receipt. No claims for payments made otherwise, shall be entertained. Any pin may be revoked later if the cash payment alleged to have been made directly in Firm’s Bank Account is not reflected in the bank account of the Firm or could not be confirmed by the Firm as having been received.

A PBA / IBA will immediately notify / inform the Firm, in-writing, of any change in her / his address, contact telephone / mobile number; bank particulars and nominee; etc, to enable the Firm to maintain correct and updated records.

It is to be understood by a PBA / IBA that in case any information provided by her / him is wrong, then any loss due to providing of such wrong information will be the sole responsibility of such associate herself / himself and the Firm will not be held liable for any such loss.

“PBA / IBA” cannot assign or transfer her / his rights and obligations under her / his ID, to any other person, during her / his, life – time; except to her / his nominee (in the event of her / his death) - when it will get transferred automatically and regarding which proper information along with documents will have to be provided to the Firm by such Nominee, within reasonable time.

The Firm does not accept any deposits from its “PBAs / IBAs”.

A PBA / an IBA should not use the trademarks or trade name or corporate logo or any copyrighted material of the Firm to promote her / his independent business, without the prior written approval from the Firm.

A PBA / an IBA must avoid all discourteous, deceptive, misleading, illegal, unethical, or immoral conduct or practices in her / his attempts to market and promote the sale - package (or any products) of the Firm. She / he should strictly adhere to the Business Plan of the Firm.

A PBA / an IBA will be supposed to fairly and truthfully explain the Sale Package, Opportunity, Business Plan, Policies and Procedures of the Firm to the prospective PBA / IBA.

“PBAs / IBAs” are prohibited to do the following acts: -

Conduct or promote any scheme which creates any contingency relative or applicable to the enrolment of any member into such business plan.
Any act which promises to create quick or easy money or which attracts the provisions of Prize Chits and Money Circulation (Banning) Act, 1978
Force or compel anybody to join as “PBA / IBA”.
In case any “PBA / IBA” is found to be involved in either / all of the above – mentioned prohibited acts, then the Firm may take suitable action as per the decision of it’s Management, including stopping of any payments due to such person or revoking of the ID of that person in the Firm or initiation of any legal action against such person.

Legal disputes, if any, shall be subject to the jurisdiction of Courts of Law at Delhi, where the Registered Office of “Prominent Future Vision India” is situated.
